Terms of Service
Commercial and operational terms for using PROMTIS Smart Menu, including subscriptions, customer responsibilities, data protection, availability, and termination.

1. Agreement and provider
These Terms govern access to PROMTIS Smart Menu, including the website, free plan, trials, paid modules, onboarding, support, and related services. By creating an account or using the service for a business, you confirm that you can bind that business.
PROMTIS is operated by TECHBRAIN d.o.o., Slovenia. The company name, address, and tax number supplied by the operator appear in the Legal Notice; registration details still require verification against official records. Governing law and competent courts must be specified in the applicable order or signed agreement before final contracting.
2. Accounts and authorised users
Customers must provide accurate account and billing information, protect credentials, assign roles appropriately, remove access when no longer needed, and remain responsible for activity performed through their accounts.
3. Plans, modules, trials, and billing
The service consists of a base product and optional modules. Current scope, price, billing interval, tax treatment, trial period, renewal, and cancellation terms are those shown in the accepted checkout or order form.
Payments may be processed by Stripe. A subscription is activated only after the required payment or confirmation succeeds. Except where law requires otherwise, fees already accrued are non-refundable.
4. Customer content and legal responsibilities
Customers retain their rights in menus, images, translations, prices, branding, order data, and other submitted content and grant PROMTIS the limited rights needed to host, process, display, back up, and transmit that content to provide the service.
Customers are responsible for lawful menu and price publication, allergens and consumer information, taxes, receipts, employment access, guest communications, delivery operations, and the legal basis for personal data they process through the service.
5. Data protection
The Privacy Notice describes processing for PROMTIS's own purposes. Where PROMTIS processes personal data on the Customer's behalf, the published Data Processing Agreement applies only after the parties complete the required entity fields and accept it through an order form, signed agreement, or another recorded mechanism.
6. Acceptable use
Users must not break the law, bypass access controls, interfere with availability, introduce malicious code, scrape or reverse engineer protected parts of the service, abuse trials, impersonate others, infringe rights, or use AI features to submit unlawful or unnecessary sensitive data.
7. Intellectual property and feedback
PROMTIS and its licensors retain rights in the software, design system, documentation, trademarks, and platform workflows. Customers receive a limited, non-exclusive, non-transferable right to use the subscribed service during the applicable term.
Product suggestions may be used to improve the service without an obligation to compensate the person providing them, provided PROMTIS does not claim ownership of Customer content included in the suggestion.
8. Availability, changes, and support
We aim to provide a reliable service but do not promise uninterrupted operation or 24/7 support unless a separate service-level agreement says so. Maintenance, security work, provider outages, and force majeure may affect availability.
Features may evolve where reasonably necessary for security, compliance, usability, or product development. Material reductions to paid functionality will be communicated where reasonably practicable.
9. Suspension and termination
Access may be suspended for material breach, overdue payment, security risk, unlawful use, or risk to other users or the service. Where practicable, PROMTIS will provide notice and an opportunity to remedy the issue.
After termination, access ends and Customer data is handled under the service agreement, Privacy Notice, and applicable DPA. Customers should export required records before access ends where an export is available.
10. Warranties and liability
The service is provided as available unless mandatory law or a written agreement states otherwise. Customers remain responsible for operational decisions, stock accuracy, food preparation, delivery, tax, and consumer obligations.
To the maximum extent permitted by law, neither party is liable for indirect or consequential loss. Any agreed liability cap and exclusions must be read subject to mandatory law and the final contracting entity and jurisdiction; those fields remain to be completed before production contracting.
